Photofuffle respects the intellectual property rights of others and expects members to do the same. We respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and comparable laws elsewhere.

Filing a takedown notice

If you believe content on Photofuffle infringes your copyright, send a written notice to our designated agent (contact information below) that includes:

  • A physical or electronic signature of the copyright owner or someone authorized to act on their behalf
  • Identification of the copyrighted work you claim has been infringed
  • Identification of the specific content you claim is infringing, including a direct link (URL) to it on Photofuffle so we can locate it
  • Your contact information — name, address, and email
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

Notices that don't include all of the above may not be actionable — we'll let you know if something's missing.

What happens next

Once we receive a valid notice, we'll remove or disable access to the reported content and notify the member who posted it. We keep a record of the takedown, and the content isn't permanently deleted right away, in case a valid counter-notice is filed.

Filing a counter-notice

If you believe your content was removed in error or misidentification, you may submit a counter-notice to the same contact below, including your signature, identification of the removed content and where it previously appeared, a statement under penalty of perjury that you have a good-faith belief the content was removed by mistake, and your consent to the jurisdiction of the applicable federal court.

Repeat infringers

Members who are the subject of repeated, valid takedown notices may have their posting privileges restricted or their account permanently suspended, consistent with our Terms of Service.
